Any order placed on the website constitutes full and unconditional acceptance of these Terms.

Payment is due at the time of order confirmation and implies acceptance of the prices, product descriptions, and these Terms.
4. Shipping and Delivery
Orders are shipped from France via Colissimo.
Approximately 95% of orders are dispatched within 48 business hours after payment confirmation.
Delivery times are provided for information purposes only and are not contractual.
EVOLV GYMWEAR cannot be held responsible for any delay, loss, or damage once the parcel has been handed over to the carrier.

5. Returns and Refunds
Customers have 14 days from receipt of their order to request a return.
Items must be new, unworn, unwashed, and returned in their original packaging.
Return shipping costs are borne by the Customer, except in the event of an error or a defective product.

6. Liability
EVOLV GYMWEAR shall not be held liable for any delay or failure in performance resulting from force majeure or other external circumstances beyond its reasonable control.

Les commandes sont expédiées depuis la France via Colissimo. 95 % des commandes sont expédiées sous 48 heures ouvrées. Les délais de livraison sont indicatifs et non contractuels. EVOLV GYMWEAR ne peut être tenue responsable des retards, pertes ou dommages une fois le colis confié au transporteur.

5. Retours et remboursements
Le Client dispose de 14 jours après réception pour demander un retour. Les articles doivent être neufs, non portés, non lavés et renvoyés dans leur emballage d’origine. Les frais de retour sont à la charge du Client sauf erreur ou défaut du produit.

6. Responsabilité

Return and Refund Policy

RETURN AND REFUND POLICY (EN)

1. General Return Conditions
If you wish to return an item, please make sure to comply with the following conditions:

Submit your return request within 14 days after receiving your order.

Once your request has been approved, you have an additional 14 days to send the parcel back.

The item must be returned in its original packaging, with tags attached and the pouch undamaged.

Items must be new, unworn, unwashed, unstained, and unscented.

Any item that is damaged, used, wrinkled, or showing signs of wear will not be accepted.
Each return is subject to a quality control inspection.
If the returned product does not meet these conditions, EVOLV GYMWEAR reserves the right to refuse the refund or to issue a partial refund based on the condition of the returned item.
If an item is defective or damaged, please inform us before sending the return so that it can be processed accordingly.
2. Defective Items
If an item is received defective, damaged, or shows a major non-conformity, please contact our customer service before initiating any return procedure and within 14 days of receiving your order.
Clear photos of the defect or non-conformity may be requested to ensure proper and timely handling of your case.
Major non-conformities refer to significant issues affecting the quality, safety, or functionality of the product (e.g., faulty stitching, tear, incorrect model, or major sizing error).
Minor variations in color, slight measurement differences, or delivery delays are not considered non-conformities and do not entitle the customer to a refund or replacement.
3. How to Return an Item ?

Contact our customer service at support@evolv-gymwear.com or via the contact form on the Contact Us page to initiate a return.

You will receive a return label and detailed instructions.

Carefully place the item in its original packaging and include the delivery slip inside the parcel.

Attach the return label to the outside of the parcel.

Drop the parcel off at a Colissimo drop-off point or schedule a pickup (option available depending on the country).

Keep your shipping receipt and tracking number until the refund is confirmed.
If the order includes a complimentary or promotional item linked to a specific purchase condition (for example, “Free product for orders over €80”), and a return causes the total value of the order to fall below the qualifying threshold, the complimentary item must also be returned in its original condition and packaging.
If the free item is not returned, its commercial value may be deducted from the total refund amount.
4. Return Fees

France, Belgium and Switzerland : return fees are set at €6.90, automatically deducted from the refund amount.

Other countries: fees vary depending on the destination and will also be deducted from the refund amount.
5. Refund
Once your return has been received by our team:

The processing time is approximately 5 business days, and no more than 14 business days after receipt.

If the return is compliant, the refund will include the total price of the returned item and the initial standard shipping fees, minus the return costs.

Refunds are issued to the same payment method used for the original purchase.

The time for the refund to appear in your account depends on your bank (usually 3–5 additional business days).
You will receive an email confirmation once your refund has been processed.
6. Non-Compliant Returns
A return will be refused in the following cases:

The item has been worn, washed, stained, torn, damaged, or emits an odor.

The item is without packaging and/or without tag(s).

The item is damaged and was not reported prior to the return.

The returned product is missing from the parcel.
The item may be returned to the customer at their expense or be subject to a refund refusal or a partial refund depending on its condition. The customer will be notified by email.
7. Important Information

The free shipping offer on orders over €80 cannot be combined with other promotions.

Returns remain under the customer’s responsibility until received by EVOLV GYMWEAR.

EVOLV GYMWEAR cannot be held responsible for loss, delay, or damage during the return shipment.

Any unapproved or non-compliant return may be refused.

Items purchased on sale or promotion remain eligible for return unless otherwise stated.

Si vous souhaitez retourner un article, merci de respecter les conditions suivantes :

Aucun article endommagé, usé, froissé ou présentant des traces d’utilisation ne sera accepté.
Chaque retour fait l’objet d’un contrôle qualité.
Si le produit ne respecte pas ces conditions, EVOLV GYMWEAR se réserve le droit de refuser le remboursement ou de procéder à un remboursement partiel selon l’état du produit retourné.
2. Articles défectueux
Si un article est reçu défectueux ou endommagé, ou présente une non-conformité majeure, veuillez contacter notre service client avant toute procédure de retour dans les 14 jours après réception de la commande. Des photos précises du défaut ou de la non-conformité pourront vous être demandées afin de permettre une prise en charge rapide et adaptée.
Sont considérées comme non-conformités majeures les anomalies significatives affectant la qualité, la sécurité ou l’usage du produit (ex. couture défectueuse, déchirure, erreur de modèle, taille erronée importante).
De légères variations de couleur, différences mineures de mensurations ou retards de livraison ne constituent pas des non-conformités et ne donnent pas lieu à remboursement ou remplacement.
3. Comment effectuer un retour ?

Vous recevrez un bordereau de retour et les instructions détaillées.

Replacez soigneusement l’article dans son emballage d’origine et ajoutez le bon de livraison à l’intérieur du colis.

Collez l’étiquette de retour à l’extérieur du colis.
-
Déposez le colis dans un point relais Colissimo ou programmez un enlèvement (option disponible selon les pays).
-
Conservez la preuve de dépôt et le numéro de suivi jusqu’à la confirmation du remboursement.
Si la commande comprend un article offert ou promotionnel lié à une condition d’achat spécifique (par exemple, « Produit offert pour toute commande supérieure à 80 € »), et qu’un retour fait descendre la valeur totale de la commande en dessous du seuil requis, l’article offert devra également être retourné dans son état et emballage d’origine.
À défaut de retour de cet article, sa valeur commerciale pourra être déduite du montant total du remboursement.
4. Frais de retour

France, Belgique et Suisse : frais de retour fixés à 6,90 €, déduits automatiquement du montant remboursé.

Autres pays : les frais varient selon la localisation et seront également déduits du remboursement.
5. Remboursement
Une fois le colis reçu par notre équipe :

Le traitement est effectué sous environ 5 jours ouvrés, et au plus tard sous 14 jours ouvrés après réception.

Si le retour est conforme, le remboursement sera total et inclura le montant de l’article retourné ainsi que les frais de livraison initiaux, déduction faite des frais de retour.

Le remboursement est réalisé sur le même moyen de paiement que celui utilisé lors de l’achat.

Le délai d’apparition sur votre compte dépend de votre établissement bancaire (en moyenne 3 à 5 jours ouvrés supplémentaires).
Vous recevrez un e-mail de confirmation dès que votre remboursement aura été effectué.
6. Retours non conformes
Un retour sera refusé dans les cas suivants :

L’article a été porté, lavé, taché, déchiré, abîmé ou présente des odeurs.

L’article est sans emballage et/ou sans étiquette.
-
Le produit est endommagé et n’a pas été signalé avant le retour.
-
Le produit est absent du colis.
Le produit pourra être renvoyé à ses frais ou faire l’objet d’un refus de remboursement ou un remboursement partiel selon son état. Le client sera informé par mail.
7. Informations importantes

L’offre de livraison gratuite dès 80 € d’achat est non cumulable avec d’autres promotions.

Les retours sont sous la responsabilité du client jusqu’à leur réception par EVOLV GYMWEAR.

EVOLV GYMWEAR ne peut être tenue responsable des pertes, retards ou dommages survenus pendant le transport du retour.

At EVOLV GYMWEAR, we strive to dispatch all orders as quickly as possible. On average, 95% of orders are shipped within 48 business hours following order confirmation (excluding weekends, holidays, and peak periods).
All processing and delivery times mentioned on our website are indicative only and do not constitute a binding commitment. They cannot be used as grounds for cancellation, compensation, or refund.
2. Carriers and Shipping Areas
Shipments within France and Belgium are handled by Colissimo (La Poste).
International deliveries are made through Colissimo International or its local partners depending on the destination.
Delivery times vary by country and are provided for information purposes only at checkout.
3. Order Tracking
Once your order has been shipped, you will receive a tracking number by email.
A dedicated order tracking section is available on our website, accessible from the Track Your Order page.
You can also follow the delivery progress of your parcel directly on the carrier’s website.
EVOLV GYMWEAR has no control over the handling or delivery times once the parcel has been transferred to the carrier.
4. Accuracy of Delivery Information
The customer is solely responsible for providing accurate delivery details (name, address, postal code, phone number, etc.).
If an error is identified, the customer must contact EVOLV GYMWEAR as soon as possible at support@evolv-gymwear.com or via the contact form on the Contact Us page. If the order has not yet been shipped, EVOLV GYMWEAR will attempt to correct the information. If the parcel has already been shipped, even before the indicated 48-hour period, EVOLV GYMWEAR cannot be held responsible for any non-delivery, delay, or return of the parcel.
In the event of an error resulting in the parcel being returned to the sender, reshipping costs will be borne by the customer. The customer may also request a partial refund, excluding the initial shipping fees.
5. Shipping Liability
Once the parcel is handed over to the carrier, liability for the shipment transfers to the customer. EVOLV GYMWEAR cannot be held responsible for:
-
delivery delays,
-
lost, stolen, or damaged parcels,
-
tracking or handling errors attributable to the carrier.
In case of a delivery issue (e.g., parcel marked as delivered but not received, delay, or damage), the customer must contact the carrier directly with the tracking number.
EVOLV GYMWEAR may assist administratively but will not issue any refund or replacement until the carrier’s investigation is completed.
6. Unclaimed or Returned Parcels
If a parcel is not collected within the carrier’s holding period (pickup point, post office, failed home delivery), it will be returned to EVOLV GYMWEAR.
The customer may then:

request a reshipment (with additional shipping fees), or
-
request a partial refund (excluding original shipping costs).
7. Free Shipping Offer
The free shipping offer for orders above €80 applies only to France and Belgium. This offer cannot be combined with other discounts or promotions.
8. Lost or Delayed Parcels
If a parcel is marked as delivered but not received, the customer must open an investigation with the carrier.
If the parcel is lost, stolen, or damaged after dispatch, EVOLV GYMWEAR cannot be held responsible. No refund or replacement will be made until the carrier’s investigation is formally closed.
9. Damaged Parcels Upon Receipt
If a parcel arrives visibly damaged, it is recommended to:

refuse the delivery, or
-
accept it with written reservations (with photos), and
-
immediately contact the carrier.
The customer must also notify EVOLV GYMWEAR at support@evolv-gymwear.com or via the contact form on the Contact Us page within 48 hours of receipt for proper follow-up.
10. Force Majeure
EVOLV GYMWEAR shall not be held liable for any delay or delivery failure due to events beyond its reasonable control, including natural disasters, strikes, transport blockages, health crises, wars, or any other force majeure circumstances.

POLITIQUE D’EXPÉDITION (FR)

1. Délais de traitement des commandes
Chez EVOLV GYMWEAR, nous nous engageons à expédier vos commandes dans les meilleurs délais.
En moyenne, 95 % des commandes sont expédiées dans un délai de 48 heures ouvrées à compter de la validation de la commande (hors week-ends, jours fériés et périodes de forte activité).
Les délais de traitement et de livraison mentionnés sur le site sont donnés à titre indicatif uniquement. Ils ne constituent ni un engagement contractuel, ni un motif de remboursement ou d’annulation.
2. Transporteurs et zones d’expédition
Les livraisons en France métropolitaine et en Belgique sont assurées par Colissimo (La Poste).
Les livraisons internationales sont effectuées via le réseau Colissimo International ou ses partenaires locaux selon la destination.
Les délais de livraison varient selon le pays et sont indiqués au moment du paiement à titre indicatif et non contractuel.
3. Suivi de commande
Une fois votre commande expédiée, un numéro de suivi vous est envoyé par e-mail.
Un onglet dédié au suivi de commande est disponible sur notre site internet, accessible depuis la page Track Your Order. Vous pouvez également suivre l’acheminement de votre colis sur le site du transporteur.
EVOLV GYMWEAR n’a aucun contrôle sur les délais d’acheminement ou de livraison après la remise du colis au transporteur.
4. Exactitude des informations de livraison
Le client est seul responsable de l’exactitude des informations de livraison fournies lors de la commande (nom, adresse, code postal, numéro de téléphone, etc.).
En cas d’erreur, le client doit contacter EVOLV GYMWEAR dès que possible à l’adresse support@evolv-gymwear.com ou via le formulaire de contact sur la page Contact Us. Si la commande n’a pas encore été expédiée, EVOLV GYMWEAR fera son possible pour corriger les informations. Si le colis a déjà été expédié, même avant les 48 heures indiquées, EVOLV GYMWEAR ne pourra être tenue responsable de la non-livraison, du retard ou du retour du colis.
En cas d’erreur entraînant un retour à l’expéditeur, les frais de réexpédition seront à la charge du client. Le client pourra également demander un remboursement partiel, hors frais de livraison initiaux.
5. Responsabilité du transport
À compter de la remise du colis au transporteur, la responsabilité du colis est transférée au client. EVOLV GYMWEAR ne pourra être tenue responsable :
-
des retards de livraison,
-
des pertes, vols ou détériorations,
-
des erreurs d’acheminement imputables au transporteur.
En cas de problème (colis déclaré livré mais non reçu, retard, dommage, perte), le client doit contacter directement le transporteur muni de son numéro de suivi.
EVOLV GYMWEAR peut fournir une assistance administrative, mais aucun remboursement ou remplacement ne sera effectué avant la clôture de l’enquête transporteur.
6. Colis non réclamé / retourné à l’expéditeur
Si un colis n’est pas retiré dans les délais impartis (point relais, bureau de poste, échec de livraison), il sera retourné à EVOLV GYMWEAR.
Le client pourra alors :
-
demander une réexpédition (frais à sa charge), ou
-
demander un remboursement partiel (hors frais d’envoi initiaux).
7. Livraison offerte
La livraison offerte dès 80 € d’achat est valable uniquement pour la France métropolitaine et la Belgique. Cette offre est non cumulable avec d’autres promotions ou codes de réduction.
8. Retard ou perte de colis
Si le colis est indiqué comme livré mais non reçu, le client doit ouvrir une enquête auprès du transporteur.
Si le colis est perdu, volé ou endommagé après expédition, EVOLV GYMWEAR ne pourra en être tenue responsable.
Aucun remboursement ou remplacement ne sera effectué avant la clôture de l’enquête par le transporteur.
9. Colis endommagé à la réception
En cas de colis endommagé, il est recommandé de :

refuser la livraison, ou
-
émettre des réserves sur le bordereau de livraison (avec photos), et
-
contacter immédiatement le transporteur.
Le client doit également informer EVOLV GYMWEAR à support@evolv-gymwear.com ou via le formulaire de contact sur la page Contact Us dans un délai de 48 heures suivant la réception pour un suivi optimal.
10. Cas de force majeure
EVOLV GYMWEAR ne saurait être tenue responsable des retards, pertes ou impossibilités de livraison dus à des circonstances indépendantes de sa volonté, telles que catastrophes naturelles, grèves, blocages logistiques, crises sanitaires ou tout autre cas de force majeure.
